What the laws require
Incidents must be recorded in a register and, where there is a risk of serious harm, reported to the Commission d’accès à l’information and to the individuals concerned; the GDPR imposes similar notification duties.
Policies governing the governance of personal information must be adopted and communicated.
Certain projects, such as an information system handling personal information or a transfer outside Quebec, require a privacy impact assessment; the GDPR requires a DPIA for high-risk processing.
Personal information must be collected and used lawfully, and individuals must be able to exercise their rights of access, rectification, erasure and portability.
